A father who sued over the death of his young daughter from injuries in a road accident has settled his High Court action for €345,000.

Mother-of-one, Noreen Murphy, Lakeside Park, Newbridge, Co. Kildare, was almost 18 when the accident occurred at Friarstown, Co. Kildare on September 9, 2011.

Her baby Martina was only 11 months at the time of the accident and the court heard that the little girl is now cared for by her grandfather and aunts.

Mr. Justice Sean Ryan yesterday approved the settlement and said the Murphy family are to be “congratulated for rallying round” Martina who is now nearly four years of age.

The judge said it was “a very tragic and difficult case.”

Noreen Murphy was a passenger travelling in the cargo area of a Ford Transit van driven by John Connors, of Labre Park, Ballyfermot, Dublin, when the vehicle failed to take a right-hand bend and collided with a tree.

Ms. Murphy suffered catastrophic brain injuries and died six days later, on September 14, 2011, at Beaumont Hospital.

Two other passengers, one travelling in the front seat and the other alongside Ms. Murphy in the cargo area, suffered serious injuries while the driver was “more or less unscathed”, the court was told.

Noreen’s father Joseph Murphy, on behalf of his grand-daughter and family, had sued Mr. Connors alleging negligence.

In his defence, Mr Connors has alleged contributory negligence in that Ms. Murphy had travelled in the cargo area of the van where there were no seats and no seat belts.

Senior Counsel, Dr. John O’Mahony, told the court yesterday the Murphy family have taken care of Martina since her mother’s death. At the time of the accident, he said, Noreen Murphy was in sixth year in school.

  1. Very brave family – loving caring and strength, No amount of money could bring Noreen back to them – her daughter is loved unconditionally. Noreen will watch over them and keep them strong. The Murphy family are to be applauded for their bravery and strength throughout this whole horrible nightmare
